Am 10.12.2020 fand der erste digitale Vortrag des Forums Junge Rechtswissenschaft statt. Der Würzburger Nachwuchswissenschaftler Dr. Sören Segger-Piening (Universität Würzburg) stellte seine Thesen zum anwendbaren Recht bei internationalen Datentransfers vor. Er schaffte es, ein höchst komplexes technisches Thema an der Schnittstelle von Öffentlichem Recht und Privatrecht in internationaler Aufladung sehr anschaulich und lebendig darzustellen. Im ersten Hauptteil stand die kritische Analyse der konzeptionellen Weite von Art. 3 Abs. 2 DSGVO (räumlicher Anwendungsbereich) als einseitige Kollisionsnorm im Vordergrund. Segger-Piening wies insbesondere auf eine hierdurch bedingte Gefährdung der Informationsfreiheit der Bürgerinnen und Bürger der Europäischen Union hin, wenn Anbieter aus Drittstaaten aufgrund der dann einzuhaltenden Vorschriften der DSGVO die Zugänglichkeit ihrer Webseiten für Unionsbürgerinnen und Unionsbürger sperrten. Dies verdeutlichte er mittels farbiger Beispiele. In einem zweiten Teil stellte der Referent die Vorschriften zu Datentransfers (Art. 44 ff. DSGVO) vor und beleuchtete ihr schwieriges Verhältnis zu dem durch Art. 3 DSGVO vermittelten extraterritorialen Anwendungsbereich.
Die Vorteile des virtuellen Formats lagen bei dieser Veranstaltung des Jungen Forums auf der Hand: So konnten sich auch Kolleginnen und Kollegen der Universität Würzburg zuschalten. Die Feuertaufe des digitalen Formats wurde dank des Referenten mit Bravour bestanden und so freut sich das Forum auf den nächsten virtuellen Vortrag am 13.1.2020 um 19 Uhr (s.t.). Vortragen wird Bianca Scraback (Universität Bonn) zu dem Thema "Das begrenzte Klägerwahlrecht als Lösung für Fälle mit mehrfachem Ortsbezug nach Art. 7 Nr. 1 und 2 Brüssel Ia-VO".
