Project Description

To view law as a technology of culture means regarding law not so much as the state’s monopoly on the use of force or the implementation of a normative order, but rather as a technology and practice of regulation and formation. In this way, the focus is placed on the juridical practices that empower the (bourgeois) subject as well as the technologies and procedures that regulate them. From here the focus ultimately shifts to the cultural and medial ‘places’ along with the conditions for the implementation of these technologies as well as the aesthetic and symbolic processes which accompany and enable the implementation. Using the examples of the contract, sense of justice and human rights, this research project investigates and describes the operating principles of law as a technology of culture.  

Sub Projects

Homo contractualis (Sigrid G. Köhler)

The aim of this subproject is to delineate the relevance of the contract for the self-description of the modern human subject as well as for the operation of the modern, bourgeois world. To this end, we analyze canonical texts from literature, philosophy, and law from the turn of the 19th century that present the ‘homo contractualis’ in various situations: in conflict resolution through the private use of contracts; in social networks; in the republican founding of the state; in the moral regulation of actions and behaviors (e.g., in marriage); in the consensual and coordinated use of communicative signs; and finally, in the political (re)framing of historical events as bourgeois contractual situations against the Restoration. As a substantial research result, we were able to show that the private law contract around 1800 both functions and is reflected as an enabling figure that regulates as well as molds human behavior as a workable form of action and thus as a cultural technology even beyond the letter of the law. A further finding of this project established that a sense of morality and justice were essential for the moment of self-binding, or commitment, through the contract. This non-rationalizable moment of the contract explains why a supposedly rational figure like the contract can even be found in romantic texts and why aesthetics, i.e., the perception, mediation, and representation of the contractual act, is so important for the success of the contract.

This subproject has been concluded. A series of articles have been published and the book publication is in preparation (see publications below).
 

Rechtsgefühl als Selbstgefühl (Sigrid G. Köhler / Florian Schmidt)

This subproject elaborates upon the formation of a ‘sense of justice’ in the 18th century and explores its relevance for various discourses and areas of law. In doing so, we have shown in this project that the notion, and especially the concept, of a ‘sense of justice’ was verifiable well before Kleist’s Michael Kohlhaas (which is commonly cited as its first instantiation) namely in the natural law of the 17th century. The Enlightenment conceived of the ‘Human’ as rational and sensitive, feeling being and positions the human as the point of departure for the conceptualization of the law and the state. The sense of justice enables the description of the citizen and legal subject as feeling person. The omnipresence of the sense of justice becomes clear against this background, which this project systematically maps with a view toward discursive places, areas of law and literary modes of representation. The fundamental hypothesis of this aspect of the project was that a sense of justice functions as a figure of subjectification and that it is related to governmental administrative technologies which extend into the constitution of subjects where their efficacy unfolds. Conversely, the understanding of the subject makes the forms and strategies of governance plausible that do not solely rely on coercion.

This subproject has been concluded. In the course of this project, we have published a monograph, a thematic volume as well as numerous articles. 
 

Menschenrecht (Sigrid G. Köhler / Florian Schmidt)

Within the framework of this subproject, we investigated different dimensions and factors which contributed to the formation of the modern concept of human rights in the outgoing 18th century. These included the nexus of human rights and sentiment; the medial formation of human rights in journals of the 18th century; and the literary invention of the human rights address prior to 1789. One thematic focus of the subproject consisted in the analysis of literary texts, in particular dramas, that originated in the context of the debates regarding the abolition of slavery and the slave trade. Within this context, these works disclose a layer of the human rights debates of the 18th century that is anticolonial, but one which is also critical of racist views that are often absent from such conceptualizations of natural law at that time.

In the context of this subproject, we published and edited a series of articles as well as thematic volume (see publication list below). 

Forensische Verfahren (Tobias Lebens)

In this subproject we investigate the ways in which forensic procedures influence contemporary literature by looking at narrative texts that deal with the post-Yugoslavian wars. Our guiding thesis is that literary texts contemporize themselves often in the mode of research and exploration and in doing so make recourse to criminological techniques which would normally guide the reconstruction of a crime. In this project, we analyze how media coverage of war, or rather the literary mediation of war reports, find their way into literary representation and how literary texts critically reflect media images and information production in their search for the ‘Truth’ of the war. This project is expected to conclude in 2023.

Recht als Kulturtechnik (Sigrid G. Köhler / Florian Schmidt)

Since the ‘law’ has proven to be a discursive and medial operator with eminent subject-theoretical relevance even beyond the letter of the law, the aim of this subproject is to systematically reflect upon and draw connections between the research results of each subproject. We conceptualize this function from a cultural studies perspective in recourse to current research conducted in the media studies landscape on technologies of culture. However, we must add three dimensions to this research: a conceptual dimension, which allows for the integration of intellectual techniques; a perspectival dimension, which would include the cultural-technic formation of the subject; and, finally, a political dimension, which allows for the comprehension of cultural technologies as administrative, regulative, and authoritative technologies. To describe law as a cultural technology means that we conceive of law as the medium of difference between nature and culture; that we analyze the workable forms of action made available by law; and that we enquire into its modes of commitment and attachment. It is the thesis of this subproject that the available forms of action through law are displayed precisely in their ability to migrate, meaning that they operate beyond the juridical context in the narrow sense, as made clear in the analysis of social, cultural, medial, and literary examples.
