Die Vorlesung vermittelt den Pflichtfachstoff im Bereich der gesetzlichen Schuldverhältnisse. Behandelt werden insbesondere Ansprüche aus dem Eigentum, ungerechtfertigte Bereicherung, unerlaubte Handlungen und Geschäftsführung ohne Auftrag.
Römisches Schuld- und Sachenrecht (SPP 3a, SPW 4b) 2 SWS
Das Schuld- und Sachenrecht des BGB wurde weitestgehend vom römischen Recht geprägt. Es werden daher die vertraglichen und deliktischen Obligationen ebenso vorgestellt wie Erwerb und Schutz von Eigentum und Besitz sowie die beschränkten dinglichen Rechte.

Institutionen des Zivilrechts in europäischer und historischer Perspektive
Die zivilrechtlichen Dogmen Deutschlands wie des europäischen Auslands fußen auf einer langen historischen Tradition, deren Hauptwurzel das römische Recht ist. Das bisher einzige Recht, das ein gemeineuropäisches Recht war, ist das römische. In einer Zeit, in der der Ruf nach einem europäischen Gesetzbuch immer lauter wird, muss sich der heutige Jurist dieser Wurzeln besinnen, um sich der Gemeinsamkeiten und Unterschiede in den europäischen Kodifikationen bewusst zu werden und dialogfähig mit seinen ausländischen Kollegen zu bleiben.
Formzwang und Vertragsfreiheit – Die römische Stipulation (SPP 3a) 2 SWS
In lockerer Runde werden einschlägige juristische Texte präsentiert, übersetzt und besprochen. Es besteht die Gelegenheit zur Anfertigung einer Seminararbeit nach § 9 Abs. 2 Nr. 3 JAPrO und § 3 Abs. 1 S. 1 lit b. PromO, die gleichzeitig eine rechtshistorisch-exegetische Übung nach § 3 Abs. 1 S. 1 lit. c PromO ist. Lateinkenntnisse sind nicht erforderlich.
