Information according to article 13 GDPR regarding applications procedures at the University of Tübingen

3. Purpose and legal basis of data processing
We process your application data in order to contact you and to enable us to determine whether you have the aptitude, ability, and professional track record for the position you are applying for. The University of Tübingen’s legal parameters for selection procedures arise in particular from article 33 para. 2 of Germany’s Basic Law; the anti-discrimination law (Allgemeines Gleichbehandlungsgesetz), and, where applicable, the state laws governing higher education (Landeshochschulgesetz) and budgetary law (Haushaltsrecht). The legal basis for data processing within the framework of a selection procedure to justify employment as a civil servant with “Beamte” status or as a regular employee is article 6 para. 1 lit. e in conjunction with para. 3 GDPR in conjunction with § 15 LDSG in conjunction with §§ 83 to 85 a LBG.

4. Recipients of personal data
The recipients of data contained in application documents are the respective personnel officer at the University of Tübingen, and where applicable the staff representative (staff council, Equal Opportunities Officer, Gender Equality Representative or Disabilities Representative).

5. Duration of storage
Your personal data/ application documents will be returned to you without undue delay or destroyed/ deleted following the conclusion of your application procedure. Further documentation arising from the selection procedure and containing your data will be destroyed six months after a rejection is issued. This applies insofar as no longer storage period is necessary for defense against legal claims.
In the case of a successful application, your cover letter and other documentation such as your curriculum vitae may be transferred to your personnel file.
Sometimes we like to add applicants for whom we have not been able to find an appropriate position to a pool of applicants, so as to be able to consider them for future positions. In this case, we will inform you and request your consent.

6. Rights of affected persons
You have the right to information (article 15 GDPR) as well as a right to correction and completion (article 16 GDPR) and/or deletion (article 17 GDPR) or to restriction of processing (article 18 GDPR) or a right to object to processing (article 21 GDPR).
Furthermore you have the right to lodge a complaint with the data protection supervisory authority, the Landesbeauftragter für Datenschutz und Informationsfreiheit Baden-Württemberg.

7. Duty to provide data
For a selection procedure to be legally binding, personal data must be provided. If relevant personal information is missing from the application documentation, that application may be removed from consideration in the selection and appointment process. The University of Tübingen’s legal parameters for selection procedures arise in particular from article 33 (2) of Germany’s Basic Law; the anti-discrimination law Allgemeines Gleichbehandlungsgesetz; and where applicable, the state law governing institutions of higher education, Landeshochschulgesetz, and/or budgetary laws. After that, the decision is made on the basis of aptitude, ability and professional track record.
